The Supreme Court decision in 1866 specified that such pardons are for offences which are known, and the pardon may be exercised after the commission of the offences. “It extends to every offence known to the law, and may be exercised at any time after its commission.”
Legal Basis for Preemptive Pardons
The legal authority for preemptive pardons in the United States is rooted in the Constitution and clarified through key judicial precedents. Article II, Section 2 of the U.S. Constitution grants the president the “Power to grant Reprieves and Pardons for Offenses against the United States, except in Cases of Impeachment.” This broad language has been interpreted to allow for pardons at any stage of the judicial process, including before charges are formally brought—a concept known as a preemptive pardon.
The Supreme Court’s decision in Ex Parte Garland (1866) is central to understanding the scope of this power. In this case, the Court unequivocally stated:
“The power of pardon conferred by the Constitution upon the President is unlimited except in cases of impeachment. It’s not as though the event is all in the past, because it’s not. Each death, when it happens is a NEW crime being committed right now in present time.
To pardon a killing in advance is to make killings legal whenever it’s pardoned in advance.
Each of those deaths is a CAPITAL CRIME, committed with malice aforethought. This applies to all of those who have died in the past and all those who will die in the future as the direct result and consequence of a crime that has already been (and will continue to be) deliberately committed with full knowledge and intent of the lethality of the act.There are TWO points that I want to make here. Both points are rather extremely important.to our future well being.
The first point is that the concept of preemptive pardon is utterly insane because it negates the bedrock foundation of what law even is. If any and every law can be set aside without question then none of those laws actually exist as law.
The second point is every bit as important as the first one and the second point is that to place the power of preemptive pardon to one Authority (such as the authority known as the President of the United States) is to make that that singular authority into the Authoritarian Dictator over everyone.
Just because he’s a “nicer” authoritarian Dictator than the last one doesn’t mean that he disapproves of the idea of authoritarian dictatorship in general, because an authoritarian dictator can be any kind of dictator that he WANTS to. That’s sorta the way it works and explains why certain types of narcissistic psychopath and/or sociopath seeks the position.
In a nutshell. NO INDIVIDUAL EVER should be granted authority to override, bypass or set aside the conclusive final decision of the judicial process.
The fact that just such an abomination actually IS in the Constitution goes a long way toward explaining how we got to this pitiful state of “pardoning” career criminal murderers so that they can go on killing.
Article II, Section 2, Clause 1, commonly referred to as the Pardon Clause, states:
“The President… shall have Power to grant Reprieves and Pardons for Offenses against the United States, except in Cases of Impeachment.”

Thanks for the pardon info.Those questioning the pardons don’t have a leg to stand on as far as expecting the Supreme Court to even consider such a pardon challenge.
The supreme court will simply ignore any such cases and so will lower courts.

The letter of the law serves the spirit of the law, else there would be no reason for having the law in the first place. When the letter contradicts the intent, or serves to reverse the intended purposes (such as preservation of life by prohibiting murder) then it isn’t actually law at all. It’s crime.

I don’t watch much, especially not political speeches, but I did just watch Trump’s second inaugural address. It was heartfelt, nationalistic, grandiose, narcissistic and hopeful, as well as frighteningly hubristic. He did thank and honor lots of working people, and Dr. Martin Luther King, while publicly shaming half of the people on the podium, after respectfully naming them.
Trump intends to expand the US without war, while building the strongest military ever. He will lock down the borders with emergency powers, engaging the armed forces thereby to defend them and expel illegal immigrants, criminals first. He will designate drug cartels as terrorist groups and wage war upon them.
Trump-II is declaring an energy emergency in the country with the most oil and gas, to “drill, baby drill”, export more, and especially bring global manufacturing to this energetic land-of-plenty.
Rather than taxing American workers, Trump will tax foreign countries through their exports to the US. The stated goal is to repeat the success of President McKinley in building up US industry through protectionist tariffs and national infrastructure projects. Mount McKinley gets that name back. Americans will build more and better cars than ever, but not electric. There are two sexes again. The “Gulf of Mexico” is on the way out, but I’ll still call it “the gulf”, like Texans all do.
Trump repeatedly invoked God, convincingly so, as in regards to his being the chosen instrument of God to carry out the manifest destiny of America.
At one point, the way he evoked “our God”, with a pause and emphasis, made me wonder if he had referred-by-omission to Satanic forces as the implied adversary.
Prayers were by a rabbi, a cardinal and a black pastor. (I had to turn the sound off for those sermons, except for snippets. Scott Bessent: You raise a very important question and one that I will investigate further. I was unaware, until the past few days, of this with the new exchange. What I can tell you, as a student and professor of economic history, is that it is important for the U.S. – for the U.S. Treasuries, for us to be able to resolve any stress issues in the markets in the U.S. We saw during the Lehman Brothers bankruptcy, that much of the, many of the problems emanated from the U.K. subsidiary, so this is something that … my inclination is that the resolution authority must lie here in the U.S., but I will get back to you in writing with an answer on this, if confirmed...

..Scott Bessent’s mention of Lehman Brothers reminded me of another kind of manipulation described by Moolfolk.
I condensed Moolfolk’s prose in this newsletter last May:
“In broad strokes, [The Great Red Dragon] documents the takeover of the American economy by British banking interests. Their methods entailed periodically flooding the economy with credit and generating a boom. Then, when the bankers’ nets were full and everyone was in debt, the bankers would abruptly withdraw credit. The practice was simply predatory. The triggering event usually involved a high-profile bank failure, which would cause an economy-wide avalanche of bankruptcies. Large, politically connected banks would then take over choice businesses, farmland and real estate for pennies on the dollar. Some 18 years later (1983), Lord Jacob Rothschild suggested that, “Two broad types of giant institutions, the worldwide financial service company and the international commercial bank with a global trading competence, may converge to form the ultimate, all-powerful, many-headed financial conglomerate.” …

..There is no such thing as a post-industrial economy, though. Even if a country ceases to produce all the stuff it consumes, it has to import them from somewhere, lest it becomes a truly post-industrial nation — one without an economy to speak of (at least in modern terms). The “service economy” representing 72% of US GDP still consumes houses, products, raw materials and energy — produced only partially by the remaining 28% of the economy — necessitating the import of cars, pharmaceuticals and even crude oil to make up for the difference. To make things worse (or rather, as a result of turning every economic activity into a “service”), now basically every part of the economy carries a massive administrative overburden. A class of non-productive, but nonetheless actively consuming workers, and not just in the government. As a congressional staffer in both House and Senate I experienced the power almost daily. I still remember the day when I was on the floor of the US Senate and Strom Thurmond, the fourth longest serving senator in US history, tapped me on the shoulder. A vote was before the Senate whether to partially pay for a reduction in marginal income tax rates by reducing a military appropriation. Senator Thurmond said to me: “Don’t ever let your senator vote for a reduction in military spending. If he does, he won’t be reelected, and you will be out of a job.” He brought clarity to me that survival as a senator meant accommodating the profits of the armaments corporations, not the living standards of the taxpayers.
Thurmond, who served in the Senate for almost half a century, was no novice. He was educating me that whatever the interest of Wall Street and the financial sector in lower tax rates, their power was less than that of the military/security complex. As sometimes there were conflicts between the interests of lobby groups, it was important for a Senate staffer to know the hierarchy of power rankings...

As a member of the House, she was a strong critic of the Foreign Intelligence Surveillance Act, legislation that I am convinced is unconstitutional and the foundation of a police state… In 2020 together with Rep. Both Democrat and Republican senators have made it clear to her that any repeal or lax enforcement of “national security” legislation must be disavowed if she expects the Senate to confirm her in office. ..Commentators unfamiliar with Washington are denouncing Gabbard for “selling out”… It is so much easier to denounce than to understand. I often think that Americans do not want to understand how things really work, because it is so distressing. So they stay in denial, and this renders them useless in bringing change and protecting their liberties.
Tell me before you condemn Tulsi Gabbard, would you rather have her, a person fiercely opposed by the military/security complex, or a person to whom the military/security complex has no opposition? “I’m wondering how a preemptive pardon might actually work (procedurally speaking) in an actual Grand Jury, Prosecutor’s Office or Court Room.
Does the person of interest tell the Grand Jury, “I don’t have to answer any questions because I have an unconditional pardon, in advance, for anything and everything that you might ask me about.”
Does the District Attorney not even launch an investigation into missing funds and several suspiciously dead bodies because the suspected perpetrator has a “preemptive” Presidential Pardon which forgives any and all crimes at any and all times?
And can a jury find a murderer guilty of a provenly premeditated killing (injecting a known to be deadly Vaxxine, for example) when the hit was ordered by a person who has been presidentially pardoned for intentionally creating the known-to-be-deadly injection and forcing other people to use it? (Anthony Fauci springs to mind).
This is a serious question. Just HOW does a carte blanche pardon work in the real world of law enforcement and jurisprudence? Imprudently, I think, or not at all.”

tdk: wrong. the prep act prohibits such things. fauci needs no pardon. it’s all show.
Don’t give up yet. According to that link about the PREP Act, the liability protections are only for Covid-19 countermeasures which are also approved by the FDA or otherwise authorized (such as with an EUA).
Fauci and his underlings were involved with gain of function research and other questionable activities beyond the Covid-19 umbrella.
